Family sues CIA over scientist's mysterious death

The sons of a Cold War scientist who plunged to his death in 1953 several days after unwittingly taking LSD in a CIA mind-control experiment sued the federal government Wednesday. They claimed that the CIA murdered their father, Frank Olson, by pushing him from a 13th-story window of a hotel ? not, as the CIA says, that he jumped to his death.

Sons Eric and Nils Olson of Frederick, Md., sought unspecified compensatory damages in the lawsuit filed in federal court, but their lawyer, Scott D. Gilbert, said they also want to see a broad range of documents related to Olson's death and other matters that they say the CIA has withheld from them since the death.

Olson was a bioweapons expert at Fort Detrick, the Army's biological weapons research center in Maryland. Their lawsuit claims the CIA killed Olson when he developed misgivings after witnessing extreme interrogations in which they allege the CIA committed murder using biological agents Olson had developed.

The CIA had a program in the 1950s and '60s called MK-ULTRA, which involved brainwashing and administering experimental drugs like LSD to unsuspecting individuals. The project was investigated by Congress in the 1970s.

Olson consumed a drink laced with LSD by CIA agents on Nov. 19, 1953, the suit says. Later that month, after being taken to New York City purportedly for a "psychiatric" consultation, Olson plunged to his death.

At the time ? when Eric and Nils Olson were 9 and 5 years old, respectively ? the CIA said he died in an accident and did not divulge to his family that Olsen had been given LSD.

But in 1975, a commission headed by Vice President Nelson Rockefeller released a report on CIA abuses that included a reference to an Army scientist who had jumped from a New York hotel days after being slipped LSD in 1953. Family members threatened to sue, but President Gerald Ford invited the family to the White House, assuring them they would be given all the government's information. CIA Director William Colby handed over documents and the family accepted a $750,000 settlement to avert a lawsuit.

In an email, CIA spokeswoman Jennifer Youngblood said that while the agency doesn't comment on matters before U.S. courts, "CIA activities related to MK-ULTRA have been thoroughly investigated over the years, and the agency cooperated with each of those investigations." She noted that tens of thousands of pages related to the program have been released to the public.

In a statement, Eric Olson said that the CIA has not given a complete picture of what happened to his father.

"The evidence shows that our father was killed in their custody," he said. "They have lied to us ever since, withholding documents and information, and changing their story when convenient."

Forward! Start That Project! Kumbaya | Design Sense

Forward!  Start That Project!  Kumbaya

It's quite typical of me to ponder and not blurt out long thoughts or commentary.? Sometimes that inclination makes me feel that blogging is not my speed, and then I see other bloggers that emote even less than I do?I guess that makes us more essayists than bloggers?

So here we all are, two days after the day everyone was reacting so spontaneously.? Forward!

Yes, I do think that the Interior Design and architecture, decorating, building, puttering and remodeling world can enjoy positive changes now.? Many, many people have been hiding out or cowering in corners fearful of making decisions and investments that are not only about money but also about time.? I see and hear people who are afraid to make any commitment to change or improve their homes or their offices because of what "could" happen.? They could choose to go forward, but are hesitant to commit.

Party leanings aside, we can decide to keep waiting or act on what we need to do?not just spiritually, but in our own surroundings.? Unless we know we really can't, let's start!? Pull out that list or a pad and pencil or "reminders' on your laptop or phone and start making notes.? It could be a long complex list from rebuilding or remodeling or moving to a bigger, smaller, older, less expensive home that needs work.? It could mean moving your office home or setting up a satellite location to do your work and save on gas money to and from the office 10 times (or more) a week. ?Or, it could be adding some storage or tiling a bathroom.

It might seem that whomever you talk to or talk about with friends and co-workers has a formal business set-up and would only handle the "big jobs".? I think that if you and this professional connect well, he or she could tailor their terms or fees to accommodate a smaller job or an on-going project (MY expression).

"Blah, blah, blah", I know:? be careful about hiring the wrong, inexperienced and/or unqualified.? If you are very lucky, you can get more than you paid for, but I would not count on it and please don't fool yourself.? Many (but not all) of my resources have a retail segment of their business (not just the "to the trade" for Designers, architects and/or builders) so look for them or ask someone willing to recommend (like me) without taking over the project.

We should all get going and help each other.? Even Congress in considering cooperation! It's been a long recession. ?Start with the repairs and re-do's that shouldn't wait. ?A smart Do It Yourself project can involve products or services from someone who will appreciate your interest, the work and the dollars.? Think about that!

"Come Together". . ."Kumbaya".

My family adores board games. ?In fact, we try to set aside at least one night per week to have a family game night and always invite guests to join in, too. ?It's certainly a terrific way to spend quality time together.

If Calvin Johnson keeps talking, the Lions eventually will be making a $20,000 contribution to the Human Fund.

With four NFL teams already fined that amount this season for violating the league?s injury-reporting rules, the Lions could be in line for a similar sanction, for failing to list Johnson on the injury report due to the consequences of a hard hit he absorbed earlier this year from Vikings linebacker Chad Greenway.

Johnson previously said he suffered a concussion on the play; the team denied it.? Now, via Paula Pasche of the Oakland Press, Johnson said he believes the concussion also may have caused nerve damage.

?Actually I had some nerve damage that was kind of messing up my grip a little,? Johnson said. ?Not to blame that, but I think that the concussion could have had something to do with some of that damage I had going on.?

Johnson has missed plenty of practice time in recent weeks with a knee injury, but he hasn?t been disclosed this season as having a concussion or nerve damage.

Last week, Ravens coach John Harbaugh complained that players who are able to practice and play with injuries may not want their conditions to be publicized.? For players like Johnson and Bills defensive end Mario Williams, the injuries are being disclosed not by the team, but by players who may be trying to explain diminished performance.

That?s why teams tell players not to talk about injuries ? and it?s why the Lions could eventually find themselves getting fined for what Johnson has said.

My Furbaby | Digital Scrapbooking, Scrapbook Templates, Digital ...

Yesterday our family had to say goodbye to our furbaby Zoie, our baby?of almost 14 years. Zoie came into our lives in 1999 as a little bundle of fur with huge feet. A co-worker of mine at the time brought her into the office after saving her from a busy parking lot where someone had dumped her out of a car and drove off. My co-worker said that if no one wanted her, she would have to take her to the human society because she was allergic to dogs. I quickly called Joe to ask if I could bring her home and being the canine lover that he is, he said yes.

That little bundle of fur grew into a hundred pound ball of energy! She was always timid and loving, hardly ever made a sound. As a puppy she loved to chew on things, mostly her favorite squeaky toy hamburger, but she also managed to chew off a corner of a chair and a hole in the dry wall of our old house. She loved to play fetch and wrestle with our other dog Sadie. We used to joke that the kids could take rides on her because she was so big and strong. Being so large and playful had it?s disadvantages at times, like when friends would come over with their kids and she would get so excited to play that she would hip check people and send them flying. Eventually she outgrew the hyperactivity and settled down to become a gentle giant.

After our other dog Sadie passed away, Zoie started doing endearing things that we hadn?t noticed before. In the morning she would stand at the bottom of the stairs and ?talk? to us. She sounded like Chewbacca from Star Wars, it was her sweet way of telling us she was hungry or had to go outside. At night she would go up and sleep in the boy?s room on their floor or would lay in the hall between their room and ours. She was definitely the faithful protector of her family and liked to be close to us.?Zoie would also lay in my office with me while I worked. She was good company and my office feels very lonely without her.

She was the best dog I have ever had and I miss her terribly. It has been a long few month of her dealing with an ever growing tumor though, so I do find comfort knowing that she is finally at peace, but damn I miss my dog.

89% Keep the Lights On

Think of "Keep the Lights On" as a companion piece to last year's wondrous little film "Weekend" (which was on my Top 10 list of 2011). Gay men, who have played a major role in creating and developing cinema, are FINALLY turning their cinematic attention to gay relationships. It only took 100 years. And we're not talking about superficial melodrama or soft-core porn. There's no beefcake in either one of these films. These are also not coming-out stories. This is thoughtful, subtle, realistic reflection on the dynamics of adult gay relationships. Boyfriends. Whereas "Weekend" examined a brief affair with the potential to grow into a long-term relationship, "Lights" depicts a long-term relationship -- with many ups and downs. But not for a second is it melodrama. Writer/director Ira Sachs, who made his first feature film, "The Delta," about 15 years ago (which I haven't seen), brings to life the story of two well-educated Manhattanites who have an anonymous sexual encounter that grows into a 10-year relationship. One is a documentary filmmaker; presumably this at least to some degree represents Sachs himself. The other is a literary agent and book editor. Thure Lindhart, a Danish-born actor, plays the filmmaker. Lindhart took my breath away two years ago in the Danish film "Brotherhood," which was on my Top 10 List of 2010. It's fantastic to see him breaking into American cinema. I guess I wasn't the only American who noticed "Brotherhood." Zachary Booth plays the literary agent. Booth is perhaps most recognizable as Glenn Close's son in the brilliant TV show "Damages." After a few years of relative happiness, the relationship runs into serious difficulty when the literary agent drifts into drug abuse. The film doesn't slip down the rabbit hole of lurid drug voyeurism. We don't go along with this man on his weekend-long drug binges. The film is mostly concerned with the emotional wreckage that results after the binge is over. We see the aftermath, not the drug binge. There's only one scene that depicts one of the binges. And here again, the focus is not on the binge itself so much as the emotional responses of the sober boyfriend who witnesses it. The film also nicely explores the ways that the filmmaker gets emotional support from his diverse circle of family and friends. But unfortunately the analysis in "Lights" never cuts that deep. It's thoughtful but only in a sketchy way. It hints at ideas more than explores them. The film also is not edited that well and starts to feel repetitious after a while. There's no denying, however, that "Keep the Lights On" is one of the better films of 2012 and a wonderful addition to what will hopefully grow into a sub-genre of serious gay cinema.

EDMONTON ? A new piece of provincial legislation designed to streamline the approvals process for resource development is being dubbed a ?Franken-bill? and ?a train wreck? by critics.

While the government defends it as ?a common-sense approach,? opposition MLAs say Bill 2, the Responsible Energy Development Act, merges six conservation statutes to create a one-window regulator at the expense of landowners and the environment.

?It feels a bit like a Franken-bill,? Wildrose Leader Danielle Smith told the legislature when the bill was given second reading last week. ?It?s bringing in all of the different elements of a variety of different pieces of legislation, squashing them together, and hoping that by naming it under a single regulatory agency, somehow it?s going to solve the many problems.?

Critics say the bill is plagued with flaws, but the most critical problem is the removal of the right of a landowner to go before the Environmental Appeal Board.

They say the bill also narrows the scope of who can trigger a public hearing into a project, gives too much power to the ministers to override decisions, lacks timelines and attempts to bypass the constitutional right of aboriginal people to be consulted on projects on their traditional lands.

Keith Wilson, a St. Albert lawyer who held meetings across the province last year to rally rural opposition against four previous controversial provincial land use bills, called Bill 2 ?a train wreck.?

?Bill 2 is sloppy legal drafting and bad policy insofar as it strips the most affected by energy projects of their legal right,? he said.

The bill gives the new regulator ?unfettered discretion? in deciding whether landowners get any notice of any developments near their property or whether they have any right to a hearing or other participation in the process, Wilson said.

But Energy Minister Ken Hughes rejected the contention Bill 2 could trigger a storm of outrage across the province like previous land-use bills. He said the bill is ?a common-sense approach that creates a more effective and efficient system.?

?There?s no reason people should feel that this is anything like those other bills,? he said.

Hughes said the bill provides more rights to landowners than some of the previous legislation.

?Under this new legislation we actually are requiring the new regulator to notify everybody who is directly and adversely affected,? he said. ?The notice is intended to ensure that at the front end of the regulatory process there is a complete, thoughtful and common sense approach to hearing all of the issues of all of the parties that are affected.?

Hughes added the appeal process is ?just as robust as it is today in the existing Energy Resources Conservation Board (ERCB) regulation? although the appeals will be go to the regulator?s commissioners rather than the Environmental Appeal Board.

But Cindy Chiasson, executive director of the non-profit Environmental Law Centre in Edmonton, said that?s akin to ?self reviews by the regulator of its own decisions.?

She said the new hearing commissioners may be more independent of the ERCB, but ?there is still a perception of bias.?

?As much as they say this is not the ERCB, this new regulator will end up carrying some of the ERCB?s baggage in terms of the perception people have of it and what the past history has been in the province in terms of how energy decision-making has taken place.?

She said the bill also changes the test for standing in several current pieces of legislation from ?directly affected? to ?directly and adversely affected,? which can narrow the scope of who can demand a hearing.

?Changing it to being the regulator?s call on if and when hearings are called, I would say that?s a step backwards for landowners who may be affected,? she said.

University of Alberta Faculty of Law Prof. Russ Brown said the bill doesn?t add to the government?s powers to regulate land use, but simply consolidates those powers.

However, in the process the government has removed some procedural protections, he said.

?Under Bill 2, the consolidated regulator will be making decisions respecting the landowners land, but if the landowner has some objection or if there?s been something overlooked, they can?t appeal.?

NDP critic Rachel Notley said the concept of bringing everything under one regulator is problematic because it creates a conflict of interest.

?I think what will happen is the mandate to ensure environmental safety and sustainability of any particular development will be subordinate to the mandate to develop the oil and gas industry,? she said.

She said Bill 2 ?is very much geared toward streamlining the process for the energy industry and eliminating and minimizing the role of those pesky public interest advocates.?

Liberal Kent Hehr said he supports a one-stop shop for development approvals for industry but the bill allows cabinet to make the decisions behind closed doors.

?It doesn?t appear to be an independent body, given that the ministers of Energy and Environment and Sustainable Resource Development can tell the new regulator what its priorities should be.?

The percentage of overweight or obese children and adolescents has tripled since 1995. By 2030, according to the Centers for Disease Control and Prevention, the United States? population will include at least 32 million obese adults, many of whom are currently obese children and adolescents.

Why should we worry? As the childhood obesity epidemic has blossomed, so have rates of early-onset diabetes, high blood pressure, high cholesterol and heart disease. Perhaps more surprisingly, obesity in kids is also associated with increased rates of joint problems and injuries, skin disease and infections, poorer control of asthma, obstructive sleep apnea, kidney stones, gallstones and fatty liver disease.

Worst of all, obese kids evaluate their own quality of life similarly to ratings given by children with severe chronic or life-threatening diseases, such as cancer. They are also common targets of bullying and have profoundly low self-esteem, according to studies. Unsurprisingly, obese kids and teens also face higher rates of depression and anxiety, and are more likely to be associated with harmful behaviors, such as substance abuse and high-risk sexual activity. Primarily as a result of obesity, children of the current younger generation have a shorter life expectancy than their parents.

Maine is, unfortunately, ranked high among states with excess pounds. CDC data from 2008 show about one in every four or more adults were obese, and more than half were overweight in most counties. In 2004, more than one-quarter of Maine middle and high school students were obese. In the past 30 years, nationally, rates of obesity have doubled in children and tripled among teens.

We can point our fingers at myriad culprits: super-sized fast food, the federal farm subsidies that make processed unhealthy food so much cheaper than fresh fruits and vegetables, kids glued to computer and TV screens, persistently low rates of breastfeeding, cuts in school physical education programs, working parents stuck with the television as baby sitter and an advertising industry that still aggressively sells sugar to kids.

As a family doctor, these statistics sometimes make me want to throw my hands in the air. What are we to do? And whose job is it to do anything? The government, doctors and health systems, schools, parents or kids themselves? New federal guidelines on school-meal calorie limits may be well-intended, but they may also be failing to recognize the different needs of each child and may be generating backlash against interventions in schools in general.

So, as the candy-filled holiday of Halloween passes by, to be followed by Thanksgiving feasting and Christmas baking, try to be mindful of the influence our choices have on our kids. Stemming the tide of this problem starts with each parent, each adult who cares for a child.

* At your children?s next checkup, make sure the doctor tells you if their weight is healthy for their height. Make a plan with your children?s doctor for any changes you need to make to get there.

* If your children are overweight or obese, the younger the are when you try to intervene and teach them healthier habits, the higher the odds they will grow into healthy adults.

* Regardless of your children?s current weight, limit their exposure to advertising that promotes fast food and unhealthy snacks. Even if you are good at saying no at the supermarket, once your children become teenagers, those advertisements may still have an impact on their choices.

* Help find ways for your children to be active every day. Limit screen time.. Have screen-free weeks or weekends.

You can use the guidelines of the Keep ME Healthy ?5-2-1-0? initiative from Maine Quality Counts to start making healthy changes for your children, regardless of their current weight: They should have at least five servings of fruits and vegetables every day (not juice), no more than two hours of screen time (less is better), at least one hour of moderate physical activity (more is better) and no sugary drinks. Since no one would deprive a child of trick-or-treating fun, ration what?s left of that Halloween candy (or secretly throw some of it out), using it to replace other desserts.

It?s clear the epidemic of childhood obesity has multiple causes ? almost a perfect storm, if you will, of cultural, societal and economic factors designed to add unhealthy weight to our kids. But with each obese child heading toward obese adulthood also is an opportunity to create lifestyle changes that mean better lifelong mental and physical health.

Thursday night was the kind of celebration where going for broke was not only encouraged, it was actively sought.

All in the name of a good cause, the faux rollers were on hand at LeMont for the Leukemia & Lymphoma Society ?s Vegas on the Mon , where roulette, poker, blackjack, slots and craps were claiming most of the Monopoly money in the hands of co-chairs Jack Kessler (with Ellen ) and Mark Mason (with Myrna ), Barb and Gary Bowser Sr. , Ed and Anna Dunlap , Randy and Heather Hillier , Nadine Bognar , the Hon. Bob and Violet Gallo , Jeanne Caliguiri , Mike and Debbie Barbarita and LLS board prez Rick Wiedman .

Before the games officially began, Ralph Martin was lauded with the Mark L. Unatin Winged Victory Award for his efforts supporting the mission to cure blood cancers, an honor that came with heavy responsibilities.

?My wife will kill me if I drop this,? he joked, handing over the substantial glass sculpture to his wife, Sharon . ?I?m honored to be chosen and recognized in this way, and also humbled. The Leukemia & Lymphoma Society has done so much, but there?s still so much left to do.?

Foxconn International surges 35 percent as Citi report lifts iPhone hopes

HONG KONG (Reuters) - Shares of Foxconn International Holdings Ltd (FIH) , the world's biggest contract maker of cellphones, surged as much as 35 percent after Citigroup upgraded the stock to a 'buy' and said it expected the firm to start assembling iPhones this year.

The report, Citigroup's first positive rating on the stock in nearly three years, spurred heavy buying. The shares have languished this year because of FIH's dwindling handset-making business as its biggest customers including Nokia Oyj trail Apple Inc in the smartphone race.

FIH will see a sharp turnaround next year as Internet and software companies enter the smartphone race and the firm starts assembling iPhones for Apple, Citigroup said.

"Amazon , Google , Microsoft , Xiaomi, Baidu , Tencent are all trying to launch smartphones and none has in-house manufacturing," Citigroup said, raising its target price on FIH to HK$5.80 and its earnings estimate for 2013 by 134 percent.

Shares of FIH, which assembles handsets for the likes of Huawei Technologies Co Ltd and ZTE Corp , jumped as high as HK$3.69 in their biggest one-day gain ever.

That compared with a 0.4 percent drop in the benchmark Hang Seng Index <.hsi>.

FIH shares are still down nearly 30 percent this year compared with a near-20 percent rise for the broader index.

FIH will receive orders of up to 200 million lower-to-mid-end Chinese smartphones next year, including the popular Xiaomi smartphone, said Alex Hu, chief of propriety trading at Mega Securities.

HON HAI

Hon Hai Precision Industry Co Ltd , the main supplier of Apple's iPhones and an affiliate of FIH, fell 1 percent in Taipei trading, against a broader market decline of 0.6 percent.

Due to difficulties in recruiting labour at Hon Hai's iPhone factory in China, some production has been moved to FIH since October, Citigroup said.

Citigroup said it expected FIH had started metal casing production for iPhones in October, and forecast final assembly would begin by the end of the year, with Hon Hai gradually shifting 10-15 percent of iPhone production to the company.

Hon Hai and FIH are both units of unlisted Foxconn Technology Group, founded by Taiwanese billionaire Terry Gou.

"The stock (FIH) has been underweighted for a long time. If the plan as mentioned in the (Citi) report is a success, it will be a huge turnaround story for the company," said Steven Leung, a sales director at UOB Kay Hian.

In August, FIH posted its worst-ever first-half net loss due to dismal orders from key clients such as Nokia and warned that uncertainties in global handset demand were dimming its outlook for the rest of the year.

Biden: GOP ticket running 'con game' of moderation

LAKEWOOD, Ohio (AP) ? Vice President Joe Biden says presidential nominee Mitt Romney and his running mate, Paul Ryan, are running a "con game" on voters, trying to them into thinking the Republican ticket is more moderate than it is.

Biden is pointing to Romney's changing positions on tax cuts, Iraq and other issues.

Biden tells a crowd of 1,200 people at Lakewood High School outside of Cleveland that the GOP ad on Jeep moving jobs out of Ohio was "pernicious" and a sign Romney does not have the character to be president.

The vice president says President Barack Obama "does not engage in deception. He says what he means and means what he says."

Biden says average people don't expect government to solve their problems, but "to understand" their struggles.

THE King of Kopala Swag and the man of the moment Macky II last Saturday thrilled his home town fans during the Miss Summer Beauty Pageant held at Chingola Arts Society.

Self proclaimed local Rap Legend, Macky II the multi-talented artiste stepped on stage half to mid night only to the cheers of his fans that seemed to know every lyrics of each song even before he sang it.

The singer who is a producer, song writer, cover designer and video editor seemed to have perfectly diagnosed his entertainment sick fans and administering the rightful drug the deprived music to his fans.

Stepping on stage with Nangu Banchinge, Seka Uponoke, the artiste charmed the fans with his Kopola Swag dance no wonder he is among the few local artists not to have recruited the dancing queens.

Yet the perfect moment was when the Kopola Swag King retuned on stage inviting the coolest ?super natural? woman of the night Judy to perform the duet Without You.

This was the time Judy showed that she is an artiste standing tall in the music industry and her unique dance coupled with decency made the crazy and wild fans to stand and watch in amazement.

Judy?s sweet melodies stepped up the tempo when she dropped the Anaka, the track denouncing gender violence and condemning husbands that beat their wives without apparent reason or on petty issues.

The divas performance was above reproach this night as B-Nell the artist that had gone in oblivion showed that she had not gone on musical holiday.

With Bola the artiste that has gained weight lately, seemed not to have forgotten her dancing prowess though at times seemed to have taken the role of the dancer rather than that of the performer.

B-Nell is a dancer; song writer and singer that at times under estimate herself as she has great potential to grow into a household name.

At this wonderfully organised event Starface stepped up with Gender and Mwaume Mwaume, the young boy appears to have much to have to offer on music stage especially with the passage of time.

Landlord who in his early music career has recruited two dancing queens offloaded his Chitemweko Chiwama Chungulo.

The beat and the lyrics are excellent and the young man has risen on the ladders of Bravo Records Studios.

But it would be appropriate for the artist to realise that he is an upcoming artist and once allowed to share stage with Big names such as Macky II and Judy to go straight into performance and reduce much talking.

Actually he didn?t complete the performance of his first track as much time was consumed by his much talking.

Hosting my 5-week series, Willow Bird Baking Challenge, has been so much fun. I thought instead of posting with each batch of results, I would do a big round-up here of everyone's creations over the 5 weeks.

To recap, Willow Bird Baking Challenge was a 5-week series wherein I introduced a new challenge each week. The challenges required bakers to get innovative in the kitchen. Coco Bamboo restaurant review: Brazilian and Caribbean cuisine in ...

Coming into this cosy, tropical-hued restaurant from blustery Chalk Farm Road is an instantly warming experience.

The walls are painted in lime green and shocking orange, and the first thing you see is a giant bar, well-stocked with cacha?a, rum, fresh fruit and everything else you might need for an exotic cocktail.

We?re here for a leisurely Sunday afternoon lunch, and while about half the tables are full and there?s plenty of atmosphere, this restaurant definitely seems like more of an evening joint.

The grub All the Caribbean staples are on the menu here, such as jerk chicken and curried goat, along with Brazilian faves including feijoada, a pork and black bean stew.

We begin with saltfish and ackee (Jamaica?s national dish), delicately presented with arty drizzles of balsamic vinegar and baby tomatoes. It?s a small portion but bursting with flavour.

Two stonking main courses arrive next: my date gets stuck into juicy cuts of beef, pork and chicken that make up the mixed barbecue, while I?ve got a Brazilian fish moqueca, a light fish stew with soft tilapia cooked in a creamy coconut and sweet red pepper sauce ? I clean my plate.

Dessert is equally lip-smacking ? chocolate and brazil nut terrine comes with a kicking spicy chocolate ice cream. The banana cheesecake, which the waitress tells us she can?t get enough of, definitely lives up to the hype.

It?s smothered in caramel sauce and desiccated coconut, with a layer of gooey banana over the biscuit base. Delish.

Behind the bar Naturally, rum punches, batidas and caipirinhas are the order of the day here.

Try the ultra summery mango and coconut batida, which comes with cacha?a, coconut cream and maraschino liquor.

Bill please Starters from? ?4.90; mains from ?10.95; desserts from ?4.50; wine from ?4.10; cocktails from ?6.80; happy hour is Mon-Fri between 5pm-8pm.

Verdict Seriously satisfying grub and engaging, upbeat staff make this a great place to pretend you?re on holiday somewhere warm and exotic.

Compliance seems to be the hardest word

Last month, Apple suffered a defeat in its global IP-war with Samsung over its Galaxy Tab tablet computer:? the UK Court of Appeal upheld the High Court?s ruling that Samsung?s Galaxy Tab did not infringe Apple?s European Community registered design.? The Court of Appeal also affirmed the High Court?s publicity order, which required Apple to post a link its UK homepage to a statement explaining that the Galaxy Tab does not infringe Apple?s design rights.? A notice soon went up on the Apple homepage, but not without raising some eyebrows.? All of the text (regarding the High Court and Court of Appeal?s rulings on infringement) appeared, but so did some extra words.? Apple had added to the statement (1) some carefully selected words from the judgment of the High Court (remarking on the qualities of the Apple design and noting that the Samsung design is ?not as cool?); and (2) references to rulings in Apple?s favour in the US and Germany.? This week, the parties were back before the Court of Appeal on Samsung?s motion.? The Court was not impressed.? Apple?s edited notice was reportedly described as a ?clear breach? of the Court?s order, which the Court was ?at a loss? to understand, and the company was given 48 hours to remove and replace the notice.? In a further rebuff, the Court declined Apple?s request for 14 days to amend the notice, disbelieving counsel?s assertion that this period of time was required in the absence of an affidavit from Apple?s senior management.

An additional wrinkle in the Court of Appeal?s judgment revolves around the multi-jurisdictional enforcement of European Community IP rights.? As Bird & Bird point out, a significant factor in the Court?s decision (see [83]) to affirm the High Court?s publicity order was the existence of a contradictory injunction made by the German Oberlandesgericht (Court of Appeal), which purported to prohibit the sale of Galaxy Tabs across Europe.? The German order was made after the UK High Court?s decision, in respect of the identical legal question, and brought the Oberlandesgericht in for some sharp criticism from the Court of Appeal: ?[i]f courts around Europe simply say they do not agree with each other and give inconsistent decisions, Europe will be the poorer? (at [63]).? While the reasons for the inconsistency are unknown, the decision points to the complexities associated with administering regional IP rights, in the absence of a regional forum for the settlement of disputes.

Technology v. The Fourth Amendment

Two recent Fourth Amendment decisions provide interesting examples of the difficult questions posed for Fourth Amendment jurisprudence by the expansion of technology-driven law enforcement practices.

The first case comes from rural Wisconsin.? The defendants sought to suppress video evidence obtained by DEA agents, who installed surveillance cameras without a warrant on private land that was being used by the defendants to grow marijuana.? The land was fenced in and said to have been marked with ?no trespassing? signs.? The Supreme Court earlier held in Oliver v. United States, 466 U.S. 170 (1984) that the Fourth Amendment does not protect against searches of ?open fields?, so that officers can lawfully search outside the area immediately surrounding the home (the ?curtilage?) without a warrant, regardless of whether they commit a trespass in doing so.? According to media reports, the United States District Court for the Eastern District of Wisconsin this week refused the defendants? motion to suppress the video, adopting the recommendation of a US Magistrate Judge.? The Magistrate Judge recommended suppression not occur because officers are permitted to enter and observe open fields, so long as they stay out of the curtilage of the home, and video showed only those areas.? Although the agents in this case installed surveillance equipment, which did not occur in Oliver, it should not be distinguished because ?the Supreme Court has upheld the use of technology as a substitute for ordinary police surveillance.?? Further, the Magistrate Judge explained, if the privacy-oriented analysis of the Supreme Court in United States v. Jones, 132 S. Ct. 945 (2012) is applied, the result is the same as there is no legitimate expectation of privacy in an open field. ?Some commentators reacted negatively to the ruling, with Ars Technica arguing that it is ?an absurdity? to determine the legality of electronic surveillance by extrapolating from the legality of a human officer making the same observations.

The second case arose in an application by the Government for access to a ?cell tower dump?.? The Government sought access to all telephone numbers and all other subscriber information for calls processed at particular cell phone towers during a relevant period of time.? The Magistrate Judge rejected the government?s application, applying authority (currently before the 5th Circuit on appeal) which held that the Fourth Amendment prohibits warrantless searches of cell tower data.? As Orin Kerr noted, the Magistrate Judge also expressed concern about the seeming lack of technological understanding of the Government?s lawyer, and the Government?s lack of any protocol for dealing with the information it obtained about innocent third parties.? But as Techdirt points out, technology is available which allows the Government to obtain cell phone data without accessing the information held by cell phone towers.

MegaUpdate

MegaUpload, the file-sharing site dramatically shut down by the US Attorney?s office earlier this year, is set to return.? The site?s founder, Kim DotCom has announced he will be launching a new cloud storage service, Me.ga, to be hosted on servers in Gabon.? The new service, according to DotCom, will rely on user-held encryption keys, giving users greater control over their content, and protecting the site?s administrators from liability.? A few days earlier, court filings in one user?s application to recover data from MegaUpload?s downed servers indicated that system?s users would not be given access to their data lightly.? In its response to the user?s motion for return of property (i.e., his data), the Government submitted that the user?s ownership of the copyright in his data would not be sufficient to establish a property interest in copies of that data stored on the seized MegaUpload servers.? For this and other reasons, it sought a separate hearing on the issue of whether the user had even a prima facie interest in the property he sought to recover.? The Government?s stance was interpreted as presenting a significant hurdle to data recovery for former MegaUpload users.
