Obama says Romney would bring a 'losing season'

TOLEDO, Ohio (AP) ? President Barack Obama warned union workers in football-crazy Ohio on Monday that Republican Mitt Romney would guide the nation to a "losing season," imploring voters in the battleground state to take his opponent's plan and "punt it away."

Before a trip to Louisiana to view flood damage from Hurricane Isaac, Obama marked Labor Day by using a series of sports analogies to dismiss Romney, who told voters in Iowa last weekend that it was "time to get a new coach. It's time for America to see a winning season again, and we're going to bring it to them."

"I've got one piece of advice for you about the Romney-Ryan game plan: Punt it away. It won't work. It won't win the game," Obama said in Toledo. "You don't need that coach. That's a losing season."

Obama was mixing politics and presidential empathy on a holiday traditionally known as an election-year turning point, with summer closing and more voters paying attention to the race for the White House. The president was trying to win over voters in Ohio, one of the seven most contested states likely to decide the Nov. 6 election.

Speaking to members of the United Auto Workers and United Steelworkers, Obama noted his decision to rescue automakers General Motors and Chrysler in 2009, a move Romney opposed.

"If America had thrown in the towel like that, GM and Chrysler wouldn't exist today," Obama said. "The suppliers and the distributors that get their business from these companies would have died off too. Then even Ford could have gone down as well."

The recoveries of GM and Chrysler have been recurrent themes in Obama's re-election campaign, particularly in states such as Michigan and Ohio.

"These jobs are worth more than just a paycheck. They're a source of pride. They're a ticket into middle class life. These companies are worth more than just the cars that they build. They're a symbol of America's innovation," Obama said. "They're a source of our manufacturing might. If that is not worth fighting for, than what is?"

Romney's campaign noted that more than 23 million people were unemployed or underemployed on Labor Day. "President Obama has a record of zero and 23 million, and it's time to get a new coach. Americans aren't better off than they were four years ago and are longing for a winning season," said Romney spokeswoman Amanda Henneberg.

Obama's pitch to working families came as Democrats pressed labor unions for their support at rallies in Rust Belt states. In Detroit, Vice President Joe Biden told auto workers at a Labor Day rally that Romney had sidestepped the auto bailout at last week's GOP convention. "You didn't hear him talk about was his position to quote, 'Let Detroit go bankrupt,'" Biden said, pointing to an editorial Romney wrote arguing against government intervention in the auto industry.

Turning to Romney's weekend football metaphor, Obama offered a lengthy sports-infused rebuttal, telling the union workers that on first down, Romney would hike taxes by nearly $2,000 on an average family with children. "Sounds like unnecessary roughness to me," Obama said.

On second down, Obama said Romney "calls an audible" and gets rid of regulations. "And then on third down, he calls for a 'Hail Mary,'" Obama said, by proposing turning Medicare into a voucher-like system for future retirees. "But there's a flag on the play: Loss of up to an additional $6,400 a year for the same benefits you get now."

"That's their playbook. That's their economic plan," Obama said.

In Louisiana, Obama planned to visit one of the areas hardest by the hurricane, St. John the Baptist Parish, about 30 miles west of New Orleans. Obama was viewing the storm damage and assessing recovery efforts before addressing reporters. Romney visited the state Friday after accepting his party's presidential nomination one night earlier.

For both men, showing election-year concern for people recovering from a disaster without making an overt political event of their visit has been a priority. The White House offered no criticism when Romney, a private citizen determined to oust Obama from his job, drew attention to the needs of the people of Louisiana ? and himself ? with his visit to the state.

Obama too has been regularly calling state officials, mayors and other officials to show support and command of the federal response. He has done so while juggling campaign rallies in Iowa, Colorado and now Ohio and working on his convention speech while aboard Air Force One.

The Democratic National Convention begins Tuesday; Obama will speak on Thursday night. Days after Isaac passed, roughly 200,000 people across Louisiana still lack power, and thousands of evacuees were in shelters or staying with friends or relatives.

One for the books...Criminal case interwined with ... - Legal Forums

Hello my Legal Knowledgeable Friends,

I would like to find out if there's a case here that would be litigious against the people persecuting me out of malice aforethought (they all knew not to do anything against me before they filed). And if so, where could I find a lawyer or someone who'd be willing to fight my case on a contingency basis and sue the heck out of these evil people and company to make sure they never do the same again...hopefully. I am currently on Section 8 Housing, although I am still an "Owner/Shareholder" in the Non-Profit Cooperative where the tenants own the property in San Francisco. I'm also on Food Stamps and am self employed with very little income the last few months . I am 53 yrs old..lived in the same unit since 1970 - took over lease(from Mom) in 1986 and live alone in 3 bedroom townhouse..my home for over 40 years. Have 20 years Banking background, was a Trust Officer - left out of stress. Filed bankruptcy and closed my only Tool Sales Business in 2005. Had a home invasion in 2008 leaving me with a broken hand and smashed face for 6 months...haven't worked much since and do pick up work when I can. Handyman, laborer mostly, with various skills.

Now for my case:
In 2010 I ran and was elected to the Board of Directors after 2 years trying to get on to change things here at my complex - 275 units over 7 spread blocks. The old Board was blackmailed into hiring The John Stewart Company to manage our property here (sic: we had previously fired this company almost 20 yrs ago for missing 10 grand not accounted for - but was coerced into hiring by last managing company over the Old Board of Directors.). The Property Manager lady who worked for the previous company transferred over to The John Stewart Company (JSCO) and got a 10 grand raise in 2008-09 when the rest of the country was falling apart. This woman has nevber done her job right, and now we are facing millions of dollars in rehab work to be done that is needed to keep our section 8 allotments for the ppty, and to fix all that was left to rot while under her watch for the last 12-13 years.

After getting on the Board I found in the ck registers we rcvd every month an illegal check writing scheme - they were writing a ck from one of OUR accts - made out to ourselves (ppty name) - and deposited into another of our accts to raise the monthly gross rcpts they base their monthly fee on. After bitching for 4 months they stopped (sort of) and refunded us almost 3 grand in overcharged fees. This is after I had already been a whistle blower on the ppty who found the last maintenance crew had ripped us off for $50-60 grand in scrap metal that belonged to us, and I had been threatened with a 10 day to quit notice over my 9lb dog ting by the work shed that he never did. It was a way to try and shut me up, only I didn't and the ppty management company covered up the things I found and decided to "retire" and then forced the old Board to hire JSCO in their place. I ran for the Board to watch things and found the above...which I knoiw was onlky the beginning.

After being on the Board for 6 months my residence was "raided by the police" in which they claimed they found various drugs and whatnot..no guns or anything, but I was arrested for the first time in my 52 years and went to jail for the first time ever (hated it...never ever want to go back!). I was charged with 5 felonies - for sales and maintaining a place solely for sales, meth, morphine, and even LSD. All this was a lie based upon my friends record who I was helping register his LEGAL cars so we could sell them. He has a past history going back some 16 years for drug sales, but had been on the up and up as far as I knew , and he was helping me by hiring me to do the paperwork and DMV stuff to get them ready to sell. He had cars parked on my street and when someone complained about the number of vehicles to their cop friend they ran the plates and saw his previous records..But a month before this "raid" we had celibratyed his birthday and the fact that his parole officer told him he was finally off parole for the first time in 16 years! The cops searched around and dug out a probation on him that was inactive but changed to active after the raid because they mis-read the report, and someone changed the records for them to ligitimize the raid at my place claiming a search and seizure on my friend and then threatening me with taking my 10 year old chihuahua to the pound unless I signed a search release for them. I did, thinking I'd be cited, but they claimed all this other crap...besides the point...there was now an arrest record on me.

That was in Nov. 2010..2 months later the Property manager posted a 10 day to Quit notice on my door for violating the zero tolerance statute in our lease agreement for the arrest. I plead my case 4 days later to the Board, they voted and decided to let me stay in my unit while my case is ongoing, I'd take a leave of absence from the Board while the case was ongoing; and most importantly they directed the Property Manager and Company to stay and further eviction actions against me until my case is over, and EVEN THEN they are to check with the Board if any further action needs to be done...not the Management Company to decide my fate...it's the Board's.

That was in Jan, 2011. Earlier this year, while my case is still ongoing to this day, and not resolved yet, I asked for the Annual Financial reports I am entitled to as a shareholder. The manager resisted, the President of the Board put of big blocks for months from allowing me to get it, even going so far as saying he needed to seek guidance on allowinjg me that report from JSCO's lawyers. The same company I had found guilty of faulty check writing forcing them to refund us money...they hated me.

So in June, at the monthly Board meeting, I announced and cited the election rules and by-laws for our property, and stated that the President is an illegitimate Board Member because he sublets his unit and hasn't lived here in 20 years - a requirement for being on the Board. He blew a gasket, and berated me to the Board and managed to get the Board to overlook his residency requirement for now, claiming that 'I had issues" and they ignored his issue of not living here.

In July at the next Board meeting the President had published some emails in the Board's monthly booklet that had info on my criminal case and communique between JSCO's lawyer and the DA in my case. This was a payback ambush by the president, who is a Lawyer by the way and wrote the directives a yr earlier as noted above. The emails show that the President initiated JSCO and their lawyers to call the DA and HUD to report me and my arrest, trying to mess with my case and have me evicted by HUD before due process was up and totally in contradiction to the Board's VOTE that allows me to stay and for them to leave me alone. One email from the Property Manager to the President states" Per our conversation, the Board wants to pursue terminating"My Name" tenacy per HUD regulations." This was said by her to cover her collabrative butt on paper, but shows the President initiated the next actions that were served upon me a week later. But The Board Never Took Another Vote, and were surprised to read that 'they' Wanted me out and evicted now...

All three parties were collaborating - The President, The Property Manager, and JSCO's lawyers, to try and force me out of my unit BEFORE my other case was over. JSCO filed papers with the Court for Unlawful Detainer against me. The order had the original Quit Notice from Jan 2011, Occupancy Agreement from 2009, and nothing else new. All wrongly filed, all done to rattle me for pissing off the President and threatening his membership on the Board. And all three KNEW THAT THERE WAS THE DIRECTIVE BY THE BOARD THAT SAID FOR JSCO TO STAY ANY FURTHER ACTIONS AGAINST ME UNTIL MY CASE IS OVER...Period! The BOARD NEVER TOOK ANY OTHER VOTE CONCERNING ME SINCE.

The Unlawful Detainer was filed with MALICE AFORETHOUGHT AGAINST ME. ALL the parties knew what the original directive was, yet they decided to try and force me out by filing with the Court in hopes I did not respond correctly or on time. I did though, and they haven't refiled the request for trial yet...10 days has come and gone...no court date set. They did not refile case...yet.

QUESTION: (Keeping in mind I have all back up documentation that shows the above...history emails both to the President and the Property Manager some time ago asking to be let alone & to allow me my day in court so I can exonerate myself. a history prior to this with the property manager having filed 2 - 3 other 10 day Quit notices on me that were invalid and meant to scare me from talking about their illegal issues. I have back up on all this abvoe, including the emails the president published that showed the DA talked to JSCO's Lawyer about my case, and shared info only spoken about in the Judges Chambers...evenm I did not know this info until I read the email and verified with my Public Defender).

Could they be sued for anything by me? The President of the Board, who also has a past history with me in emails showing his distaste for my ability to find things on mgmt...and never answering my point on point questions. His false "lying to management" that allowed them to go after me per his request...
The Property Manager who has always hated me and never called e or asked me my side of things, only that she saw an opportunity to be rid of me once and for all and signed her name to the legal filings with the court.
The John Stewart Company and their lawyer firm, who knowing that they are under a directive by the Board not to do anything against me, decided with the little nudge from the president to "forget" about that and file anway on me 2-3 weeks before my criminal case finally goes top the Preliminary Hearing. Streessing me to no end...hardly slept in 3 weeks since they did this, and worried sick they will triumph over me even though they are DEAD WRONG to do what they did to me...

And with all three powers that be over the property I live in under sectioon 8 housing, etc..with no place to go if I do get the boot...all three working towards getting me out of here now even if I am found innocent they wiull try and persecute me until either they go or I go....And I don't want to go anywhere.

Could a malice case be made (or any other case that hold them punitively responsible) on the above in California? , and how would I find someone who'd be willing to take this on contingency for me, with me? What are the odds finding anyone? I am so lost and putting up with an enormous amount of pressure now that they have shown the kind of people they are...What kind of lawyer do I call for this civil matter...nevermind the criminal..just the civil...whre and what kind would I look for?

Termites are a type of insect that eats wood for a fuel source, and if allowed to get inside the walls of someone's home can do a lot of damage. They have hugely voracious appetites and can easily lay waste to a house or barn, therefore prompt action should be taken at the first sign of a termite infestation.

There are almost 40 currently known different species of termites located all around the globe. Several varieties of subterranean termites are white in color due to lack of sunlight from living underground. They are usually much smaller in size than most termites and live in burrows that can reach upwards of 45 feet deep. The burrows can extend for several hundred feet in different directions from a central egress point. When operating above ground these termites tend to build small tunnels of mud to protect themselves from the sun and predators.

There is another common variety of termite that builds mounds on top of the ground instead of burrowing beneath it. In coniferous forests you will find species of termites that live in trees and consume them, moving on once they have eaten all they can from their current host. The majority of termites are wingless, but there are a few subterranean species that sprout wings once a year in order to fly off and start new colonies.

Termites are often mistakenly thought of as part of the ant family. Although they exhibit a lot of the social sets of ants and sometimes live in similar surroundings, beyond that they do not share a lot of the same traits. Some of the more distinctive differences between the two are that ants have antennae that are elbowed and termites do not. Ants tend to be slender at the waist while termites aren't. Although carpenter ants will burrow into wood, they don't consume it like a termite will. As a matter of fact, scientists have recently determined termite DNA to be closer to that of a cockroach than that of an ant.

Termites are similar to ants in that they live in colonies and adhere to a strict hierarchy. At the center of the nest is the queen with the king in attendance. She can lay several million eggs in her lifetime. The remainder of her colony is divided into soldiers and workers. The soldiers are responsible for protecting the nest and the queen, while the workers take care of the nest upkeep, including any needed expansion. They also take care of the larvae, and are tasked with finding and bringing back cellulose to feed everyone.

When termites eat wood fiber they put out large amounts of methane gas as a byproduct of the digestion process. Some ponder if this may contribute to global warming, as methane is considered a green house gas. On the other hand, termites consume a lot of the downed trees and other foliage in woodland areas, which helps keep the fuel source down in times of forest fires. Although considered a pest by many, termites do serve an important ecological purpose.

Thalidomide victims: drugmaker's apology not enough

BERLIN (Reuters) - Victims of thalidomide said on Saturday an apology from the German inventor of the drug that caused birth defects in thousands of babies around the world was too little too late.

Thalidomide, developed by the German firm Gruenenthal, was marketed internationally to pregnant women in the late 1950s and early 1960s as a treatment for morning sickness. About 10,000 babies were born around the world with defects caused by the drug, mostly malformed limbs or missing arms or legs.

"Having tried to remind them of their criminal behaviour across a negotiating table on several occasions, I didn't think this company would ever make things right," said British thalidomide victim Geoff Adams-Spink.

"This is an important first step. The next is to compensate everyone damaged by their so-called 'totally harmless' drug," said Adams-Spink, who heads the European Dysmelia Reference Information Centre, a support group for those with limb malformations attributable to thalidomide and other causes.

Gruenenthal, which says it had paid roughly 500 million euros to victims by 2010, unveiled a commemorative statue on Friday. At the ceremony, its chief executive, Harald Stock, said the company was sorry for what had happened to the victims.

"In the name of Gruenenthal ... I want to take this opportunity to express our deep regret over the consequences of Contergan and our deep sympathy for the victims, their mothers and families," Stock said at the ceremony in the western German city of Stolberg, where the company is based.

"SILENT SHOCK"

"We also ask for forgiveness for not reaching out to you from human to human for almost 50 years ... We ask that you see our long speechlessness as a sign of the silent shock that your fate has caused us."

Several thousand victims of thalidomide, sold in Germany under the brand name Contergan and elsewhere as Distaval, are still alive.

Gruenenthal was not reachable for comment and it was not clear whether the 500 million euros in payments had been to victims in Germany only or also abroad, where other firms marketed the drug.

German thalidomide victims get a monthly pension of up to 1,116 euros from a trust to which Gruenenthal contributes.

An Australian woman whose daughter won a multi-million dollar settlement in July against Diageo Plc, the legal successor to thalidomide's Australian distributor, said the apology was an insult.

"It's the sort of apology you give when you're not really sorry," Wendy Rowe told the Australian Broadcasting Corporation.

Lynette Rowe, now 50, was born without arms or legs after her mother took thalidomide for a month while pregnant. Her lawyers said Gruenenthal did not contribute to the settlement.

Referring to Stock's statement of 'silent shock', Wendy Rowe said: "Our family couldn't have gone into silent shock. We had to get up and face each day and every day and cope with the incredible damage that Gruenenthal drug did to Lyn and our family."

"PATHETIC"

The Rowe family's legal firm, Slater & Gordon, called the drug manufacturer's apology "pathetic": "It is too little, too late and riddled with further deceit."

Rowe's settlement followed a A$50 million payment Diageo agreed to make in 2010 to 45 thalidomide victims in Australia and New Zealand, who sought help to cope with the mounting costs of care as they were living longer than expected.

The cases have been closely watched in the United States, where a complaint has been filed against GlaxoSmithKline, Sanofi-Aventis, Avantor Performance Materials and Gruenenthal, with several plaintiffs claiming their birth defects resulted from their mothers' use of thalidomide.

The thalidomide scandal triggered a worldwide overhaul of drug-testing regimes and boosted the reputation of the U.S. Food and Drug Administration, which refused to approve the drug.

Gruenenthal said it had acted to the best of its knowledge.

"In developing Contergan, Gruenenthal acted according to the scientific knowledge back then and fulfilled all industrial standards for the testing of new medication," Stock said.

Many German thalidomide victims stayed away from the unveiling of Gruenenthal's statue, which portrays a child with shortened arms, calling it a public relations stunt.

"The fact that Gruenenthal, a billion-euro company, is paying 5,000 euros (for the statue) is a slap in the face of every victim," said the federal association of Contergan victims.

"This PR measure is supposed to signal to the public that the company still has Contergan on its agenda, without any serious effort to address the concerns of the people who have been permanently damaged."

Harold Evans, Reuters editor at large who led a campaign for compensation of thalidomide victims as editor of Britain's Sunday Times from the late 1960s, said justice delayed was justice denied.

"Fifty years of injustice is not to be assuaged by the most heartfelt apology, unaccompanied as it is by any compensation for the pain and suffering thousands of survivors endure every day," he said.

Teen pops head out of bus, hits NJ overpass, dies

FORT LEE, N.J. (AP) ? A teenager headed to a Sweet 16 party was killed after he stuck his head out of the emergency hatch of a double-decker bus and hit the underside of a highway overpass, police said.

Daniel Fernandez, of Sayreville, N.J., was among 65 teens aboard the bus Friday night as it crossed the George Washington Bridge from New York City, said Port Authority of New York and New Jersey police. The 16-year-old was pronounced dead at a hospital.

The accident occurred at the Fletcher Avenue overpass of Interstate 95 at about 6:30 p.m.

Alex Franco, a security guard on the bus, told the Daily News that he had warned the teens to leave the hatch alone.

"I told them not to open the hatch, like three or four times, but kids, they don't understand," he said.

Franco said he went downstairs to tell the driver that it was getting too hot.

"It was very hot. Everybody was dancing. Two, five minutes I was downstairs," he said. "Then I heard two guys screaming, 'Oh, my God, oh, my God.'"
